Will Judge Mazzei still be involved or is a new judge hearing Part 2?

There’s a strong case that the “must have owned home before 1980” federal statute was wrongly applied to our situation which is, we now know, exempt from federal preemption regulations. We’ve filed post-verdicts “requests” with small claims, accompanied by oodles of legal rulings, that clearly show airport noise is to be handled at the local level with no federal rules involved, allowing us to request a verdict change due to the “wrong law applied” stipulation. The City of SF will respond to our assertion, then the judges will make a ruling in a few weeks. Meanwhile, back at the ranch, we will provide the same evidence to the November 5 judge who’ll hear 16 claims in one morning. Ideally, the city of SF will drop the “before 1980” assertion that was most likely written for those filing noise claims against the US Court of Federal Claims.

By the way, after our Round 2 testimony, I confirmed via email that the reading shown above are the "raw" readings, i.e. they do not include the uplifts or "penalties" for evening and nighttime noise.

During the evening hours one needs to add an additional 4.77 decibels for each aircraft event. For nighttime hours add 10 decibels for each aircraft event.

Evening hours are from 7pm to 9:59:59pm.
Nighttime hours are from 10pm to 6:58:59am.
